General conditions of Sale


Object These General Terms and Conditions of Sale (hereinafter, the General Conditions) have as their object the regulation of the purchase of Products, carried out remotely, via telematic network, from the Website https://www.fartosrl.com (hereinafter, the Site ).

The Website owner is Farto Srl with registered office in V.le A. Guidoni, 97 Florence – 50145, registered in the Florence Company Register, VAT number 06569640482.

Acceptance of the general conditions of sale All purchases of Products made through the Site (hereinafter, the Purchase Contracts) by the users who access it (hereafter, the Customers) are governed by these General Conditions and by the Consumer Code ( Legislative Decree No. 206/2005), section II Distance contracts (articles 50 – 67) and the rules on electronic commerce (Legislative Decree 70/2003).

With the conclusion of the Purchase Contracts, according to the procedure, the Customer accepts and undertakes to observe these General Conditions. The Customer, therefore, is invited to read carefully, before making any purchase transaction, these General Conditions and, once the purchase procedure provided for by the Site has been completed, to print them or in any case to keep them, according to the preferred methods.

FARTO SRL may modify, at any time and without notice, the contents of the General Conditions, the General Conditions published on the Website at the time of the sending of the purchase order by the Customer will apply to the Purchase Agreements. The visual representation of the Products on the Site, where available, normally corresponds to the photographic image of the Products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment on the part of FARTO SRL regarding the exact correspondence of the image depicted on the Site with the actual Product; and this, with particular regard to its actual dimensions and / or to the chromatic aspects of the Products and / or packaging. In case of difference between the image and the written product sheet, the description of the product sheet always prevails.

Purchase procedure The Customer can purchase the Products in the FARTO SRL electronic catalog, illustrated in detail on the home page of the Site https://www.fartosrl.com within the respective sections by product category, as described in the relative sheets information contained on the Site, complying with the technical access procedures illustrated therein.

The publication of the Products displayed on the Website constitutes an invitation to the Customer to formulate a contractual purchase proposal. The order sent by the Customer has the value of a contractual proposal and implies full knowledge and full acceptance of these General Conditions. Successful receipt of the Customer’s proposal is confirmed by FARTO SRL through an automatic reply sent to the e-mail address communicated by the Customer and only confirms the correct reception of the proposal within the information systems.

This confirmation message will indicate an “Order Number”, to be used in any subsequent communication with FARTO SRL. The message will propose, in addition to the mandatory information by Law, all the data entered by the Customer who undertakes to verify its correctness and to communicate promptly any correction. Possible increases in costs caused by errors in data not promptly reported, will be the sole responsibility of the Customer. Each order can be viewed by the Customer on the Site, in his personal area, immediately after sending the order and can be canceled until it is sent to the warehouse for preparation.

It is possible that occasional non-availability of the Products offered may occur, in which case, if the Products chosen by the Customer are not, in whole or in part available, the order will be sent with the products available after having sent notice to the Customer regarding the products not available. Payments by Credit Card and PayPal only require authorization (See Payment Methods) or a reservation of money without an actual charge when the Customer places the order.

The payment is therefore effectively charged to the Customer only when the Products are delivered to the courier in charge of the shipment. In this phase FARTO SRL will also issue the invoice for the order. This implies that in case of cancellation of the order by the Customer (through a reserved area or through a request to Customer Service) no amount will be charged to the same and therefore FARTO SRL will not have to make any refund.

Each purchase contract stipulated between FARTO SRL and the Customer shall be considered concluded with the acceptance of the order by FARTO SRL. FARTO SRL has the right to accept or not, at its discretion, the order sent by the Customer, without the latter being able to make claims or rights whatsoever, for any reason, including compensation, in the event of non-acceptance of the order itself . In particular, FARTO SRL reserves the right not to accept purchase proposals and cancel orders that do not give sufficient guarantees of solvency or if – even after comparison with the circuit that handles credit card payments – anomalies in the transactions result and in the payment methods used by the Customer. The order confirmation is given to the Customer when the Products are delivered to the courier in charge of the shipment with the relative issue of the invoice. Product prices All Product prices are clearly indicated on the Website. Delivery costs are adequately highlighted at the time of the order.

The cost of each shipment, the amount of which may vary depending on the method of delivery and payment, as well as the destination and the total amount of the order. Delivery methods and costs FARTO SRL delivers to all countries listed on the Site and delivery will take place without an appointment. FARTO SRL issues an invoice for the Products purchased, at the time the Products are delivered to the courier for shipment, sending it via e-mail to the Customer. The information provided by the Customer will be used to issue the invoice. No change in the data will be possible after the invoice has been issued. No responsibility, for any reason, may be charged by the Customer to FARTO SRL in case of delay in the order or delivery of the Products covered by the Purchase Contracts. The ordered Products will be sent to the postal address specified by the Customer.

Deliveries will be made from Monday to Friday, during normal business hours, excluding national holidays. Delivery is considered completed when the Product is made available to the Customer at the address specified in the order form. In the event of non-delivery due to the absence of the recipient at the specified address, the courier will send an e-mail notice and attempt delivery the next day. In case of impossibility to perform the delivery even the next day due to the absence of the recipient, the Customer Service will try to contact the Customer to schedule a new delivery. In the event that the Customer Service is unable to contact the Customer for the next 10 days or in case of further impossibility of delivery due to the absence of the recipient, the Products object of the order will be returned to FARTO SRL Upon delivery of the Products from part of the courier appointed by FARTO SRL, the Customer is required to scrupulously check: 1. a) That the anti-tampering label is intact and the packaging is not damaged or otherwise altered 2. b) That the number of pieces being delivered corresponds as indicated in the transport document.

Any damage to the break-in label, to the packaging and to the Products or the mismatch in the number of pieces / packages or indications must be immediately contested by the Customer, who may contact FARTO SRL through the Customer Service specifying the order for which such misunderstandings have occurred. Cases of force majeure, unavailability of transport vehicles, as well as unforeseeable or unavoidable events that cause a delay in deliveries or make deliveries difficult or impossible or cause a significant increase in the cost of delivery to FARTO SRL, will give the same the right to split , defer or cancel, in whole or in part, the expected delivery or to terminate the Purchase Agreement. All data is transferred in encrypted form using an SSL certificate and cannot therefore be intercepted by external parties. Furthermore, data entry takes place directly on the Bank’s website, thus guaranteeing maximum security. The order amount is not immediately charged to the card, but at a later stage, within the limits authorized by the Customer. The authorization does not imply the debit of the money but simply a reservation of the relative amount. PayPal PayPal, an eBay company, is a fast and secure payment system. Once the payment with PayPal is completed, the buyer will be redirected to the PayPal site, where he can access his account by entering his personal e-mail address and password. After registration, payments can be made via PayPal without having to re-enter the data, even for subsequent purchases.

By choosing to pay with PayPal, the amount is debited directly from the assigned credit card (Visa, Visa Electron, Mastercard) or prepaid (PostePay). PayPal protects the buyer’s information as no financial information is passed. A confirmation email from PayPal will be sent to each transaction performed with this method. It is specified that the order amount is debited to the PayPal account at the time the courier takes charge of the order. When placing the order on the Website, an authorization request will simply be made to check availability on the Customer’s PayPal account, without any charge.

In case of cancellation the amount is refunded to the Customer’s PayPal account. Right of withdrawal Purchases made on the Website https://www.fartosrl.com are governed by these General Conditions and by the Italian law on mail order / distance sales. Pursuant to art. 64 and s.s. of Legislative Decree 206/2005 (Consumer Code), the consumer customer (ie a natural person who purchases the goods for purposes not related to his professional activity, or without indicating a reference to VAT number) has the right to withdraw from the contract of purchase for any reason and without explanation, under the conditions set out below.

To exercise this right, the Customer must send a communication in this sense, by registered letter r / r, within 10 (ten) working days from the date of receipt of the goods. The substantial integrity of the goods to be returned is an essential condition for exercising the right of withdrawal. It is however sufficient that the good is returned in normal condition.

Once the integrity of the returned Product has been verified, FARTO SRL will refund the Customer the full amount paid for the Products referred to in the Purchase Agreement subject to withdrawal, no later than 30 (thirty) days from the return of the Products themselves.

It should be noted that in compliance with current legislation, FARTO SRL will reimburse the Customer the amounts paid by the latter as the price of the Products. The Customer will bear the costs necessary for returning the Products subject to withdrawal to FARTO SRL.

Non-conformity of defective products and products The Products offered on the Site are compliant with the national and EU legislation in force in Italy. The images and colors of the Products published on the Site may differ from the actual ones due to the local settings of the systems and / or tools used for their display. In the event of a lack of conformity of the Products purchased with respect to the description published on the Site and in the event of a faulty or defective Product, the Customer has the right to a refund or replacement of the non-compliant good. Processing of personal data Customer data is processed by FARTO SRL in accordance with the provisions of current legislation on the protection of personal data, as specified in the information in the dedicated section, called “Privacy Information”. ”

Communications and complaints All communications or complaints made by the Customer against FARTO SRL relating to the Purchase Contracts must be communicated through the appropriate contact form present in the Reserved Area.

Intellectual property rights All trademarks (registered and unregistered), as well as any and all intellectual property, distinctive sign or name, image, photograph, written or graphic text and more generally any other intangible asset protected by laws and conventions international intellectual property and industrial property rights, reproduced on the Site remain the exclusive property of FARTO SRL and / or its assignors, without the Customer having any right whatsoever from access to the Site and / or the conclusion of the Purchase Agreements on the same.

Any use, even if only partial, of the same is prohibited without the prior written authorization of FARTO SRL and / or its assignors, in whose favor all the relative rights are exclusively reserved.

Competent court Any disputes relating to the interpretation and execution of contracts stipulated in compliance with these general conditions will be resolved before the competent judicial authority in accordance with the applicable legislation, in the case of “consumer” customers, while for “professional” customers the forum competent will be Florence.
